Pursuant to the Hong Kong Trade Descriptions Ordinance (Cap. 362, "TDO"), the Brand is able to substantiate all explicit product claims, including:

• "Single-origin Madagascar" — backed by D.I.E SARLU Certificate of Origin;
• "NF ISO 5565-2 grading" — backed by independent third-party inspection (SGS / Bureau Veritas / Eurofins, lot-by-lot);
• vanillin content (where stated) — backed by lot COA;
• "three generations of family operation" — backed by D.I.E SARLU and Vanille Désiré business registration documents.

The Brand assumes no liability for oral statements not confirmed in writing. "Bourbon" refers only to the botanical variety Vanilla planifolia; it is not a geographical indication.

Hong Kong is a free port and spices are generally duty-free. However:

• Food importer registration: commercial importers must register with the Food and Environmental Hygiene Department (FEHD) as a Food Importer under the Food Business Regulation (Cap. 132X), renewable every 3 years (Buyer's responsibility).
• Import declaration: must be lodged with the Customs and Excise Department within 14 days of import, electronically (Buyer's responsibility; nominal fee).
• Extract — alcohol content: vanilla extract is typically 35–40% ABV (above the 30% threshold). Under the Dutiable Commodities Ordinance (Cap. 109), reclassification as "liquor" may apply, triggering tiered duty. Whether the extract qualifies as a "beverage" or "food ingredient" is for the Buyer to determine and bears import-classification responsibility. The Brand recommends that Buyer obtain a written advance ruling from HK Customs before the first shipment.

HS codes (for Buyer's verification): 0905.10 dried vanilla pods; 1302.19 vegetable extracts (including vanilla extract). The Brand provides COA, Certificate of Origin and Phytosanitary Certificate per shipment but cannot determine HS classification or duty on Buyer's behalf.

Under ICC Incoterms 2020, customs-clearance responsibilities differ between FOB Bessan / CIF HK / DDP HK — see the Commercial Terms.
